A non-disclosure agreement is required. Exams are done by a legal professional with a J.D. This comprehensive examination takes up to seven days to complete from when payment clears and is labor intensive in checking for violations of the above. Based upon what your unique exam contains, the exam is prepared to be used by your own skilled real estate attorney specializing in utilizing the report for a pre-court settlement with the Lender’s Legal Department and is used on the offensive to negotiate punitive damages if applicable. Some clients are winning their homes free and clear, and some are winning up to treble damages based upon their exams and the skill of their attorney. Everyone’s exam is different, and it is possible your exam may not contain serious or any violations.

NOTE: This is not used for a loan modification, which typically lowers your interest rate for a few years and tacks the money on the back end, making your already overpriced home cost even more. Most loan modifications fail as a result. Loan mods typically have you waive your right to an exam for predatory lending. Courts have ruled that attorneys, who only provide a loan modification and failed to look for foreclosure defenses, have committed malpractice.
